§ 130.02. CURFEWS; LIMITED CURFEW PERIODS.

  • (A) Curfew violations.
    (1) It is a curfew violation for a child 15, 16 or 17 years of age to be in a public place:
    (a) Between 1:00 a.m. and 5:00 a.m. on Saturday or Sunday;
    (b) After 11:00 p.m. on Sunday, Monday, Tuesday, Wednesday or Thursday; or
    (c) Before 5:00 a.m. on Monday, Tuesday, Wednesday, Thursday or Friday.
    (2) It is a curfew violation for a child under 15 years of age to be in a public place after 11:00 p.m. or before 5:00 a.m. on any day.
    (3) This section does not apply to a child who is:
    (a) Accompanied by the minor's parent or guardian;
    (b) On an errand at the direction of the minor's parent or guardian, without any detour or stop;
    (c) In a motor vehicle involved in interstate travel;
    (d) Engaged in an employment activity, or going to or returning home from an employment activity, without any detour or stop;
    (e) Involved in an emergency;
    (f) On the sidewalk abutting the minor's residence or abutting the residence of a next-door neighbor if the neighbor did not complain to the police department about the minor's presence;
    (g) Attending an official school, religious, or other recreational activity supervised by adults and sponsored by the city, a civic organization, or another similar entity that takes responsibility for the minor, or going to or returning home from, without any detour or stop, an official school, religious, or other recreational activity supervised by adults and sponsored by the city, a civic organization, or another similar entity that takes responsibility for the minor;
    (h) Exercising First Amendment rights protected by the United States Constitution, such as the free exercise of religion, freedom of speech, and the right of assembly; or
    (i) Married or had been married or had disabilities of minority removed in accordance with state law.

    (B) Limited curfew period in October and November.
    (1) A curfew of 9:00 p.m. is established extending First Monday in October until First Monday in November of each year, for all youth under the age of 18 in rural Cass County and for all unincorporated towns in Cass County unless in the company of their parents, legal guardians, going to or from church, school functions or employment.
    (2) All violations will be handled in accordance with Indiana Code.
