(A) The Logansport Parks and Recreation Department has the permission of the Cass County Board of Commissioners to gather the remnant parts of the fountain in an attempt to repair, restore and reassemble the fountain for placement in Spencer Park in Logansport.
(B) If repair, restoration, and reassembly of the fountain is feasible and occurs through the efforts of individuals associated with the Logansport Parks and Recreation Department, the fountain shall remain in Spencer Park on display as long as it is maintained by the Logansport Parks and Recreation Department.
(C) All funding for the repair, restoration, reassembly, operation and maintenance of the fountain shall be the responsibility of the Logansport Parks and Recreation Department.
(D) The provisions of this section shall be in force upon acceptance of the parts of the fountain by an employee, volunteer or representative of the Logansport Parks and Recreation Department.
